BOSTON -- A Boston woman who lost a leg when she was struck by a Massachusetts Bay Transportation Authority was awarded millions by a Suffolk Superior Court jury Monday.
Woman Struck By MBTA Bus Awarded MillionsRita Traybman, who is now 61, lost her right leg in the Sept. 12, 2005, crash. Her attorney, Marc L. Breakstone, said that Traybman was struck from behind in a crosswalk at the corner of Washington and East Newton streets in Boston and that she had a "Walk" signal at the time.
A jury awarded her $3.98 million, but with interest the award exceeds $5.4 million. Breakstone said the jury found the MBTA driver was at fault in the crash."Despite the fact that she was in a crosswalk, had the right of way, and was hit from behind, there was no offer to settle this case, and as a result we had to go to a jury," he said.It is very difficult for me because I had five surgeries, but nobody can help me with the pain," Traybman said."The MBTA is reviewing the results of the trial and legal rulings carefully and is considering filing post-trial motions and an appeal, as appropriate," the MBTA said in a statement.
